Amendment VIII:
 
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.
 
Capital Punishment & the Death Penalty:
 
Black’s Law Dictionary defines capital punishment as:

capital punishment (16c) A criminal penalty that involves killing the perpetrator; the sentence of death for a serious crime. — Also termed death penalty.
